Important Information for tenants regarding the Wet Goed Verhuurderschap

Some time ago, Riva Rentals published a blog about the “Wet Goed Verhuurderschap” (Good Landlordship Act, if we translate it). This law has been in effect since July 1st, 2023, and in essence, it mandates that the Dutch government legally obligates landlords to ensure a safe and comfortable living situation for their tenants. Wet Goed Verhuurderschap

To prevent improper rental practices, the Wet Goed Verhuurderschap was proposed. On Tuesday, March 21st, 2023, the House of Representatives approved this proposal. According to the explanation by the House of Representatives, this proposal grants municipalities more authority to protect tenants against irregularities when renting properties or accommodations. This proposal came into effect on July 1st, 2023, and has implications for both landlords and tenants. In this current blog, you can find several matters that are important for tenants. What is important for you as a tenant?

We would like to inform you about some important changes that have come into effect as of July 1st, 2023, under the Wet Goed Verhuurderschap. As mentioned earlier, this law aims to clarify the rights and responsibilities of tenants and landlords and to ensure the quality of rental homes.

Riva Rentals considers it important to keep you, as a tenant, informed about key points from this recently enacted law. Therefore, we request your attention to the following 8 points outlined in the Wet Goed Verhuurderschap:

1. Usage of the residential space

The tenant is obligated to use the residential space as agreed upon in the rental agreement. Possible consequences of not adhering to these agreements are the responsibility of the tenant. For more details, please refer to the relevant articles in your rental agreement.

2. Conditions for entering the residential space

The conditions that the landlord must adhere to when entering the residential space during the rental agreement. Tenant consent is required unless there is an urgent emergency, essential work, renovation, adjacent property, or viewing for sale or new rental. 3. Types of rental agreement

Different types of rental agreements, rent and rent price protection, annual rent increases, and how the rent price can be calculated based on the housing valuation system. For an overview, we refer you to the Dutch government’s website.

4. Contacting Riva Rentals 

The tenant's ability to contact Riva Rentals in case of defects in the residential or lodging space, except for minor repairs that you are responsible for. For an overview of what falls under minor repairs, we kindly refer you to the document on minor repair guidelines provided by us.

5. Rent Committee or district court

An overview of the topics you can address with the Huurcommissie (Rent Committee) or the kantonrechter (district court). For more information on this, we refer you to the Dutch government's website.

6. Deposit

The amount of the security deposit and its refund. The security deposit may be up to 2 times the basic monthly rent. For more details, please refer to the relevant articles in your rental agreement.

7. Service fee

The tenant's payment obligation regarding the service fee. The landlord will provide you with a comprehensive breakdown of costs annually. For more details, please refer to the relevant articles in your rental agreement.

8. Municipal Reporting Point

The contact information for the Gemeentelijk Meldpunt (Municipal Reporting Point), as mentioned in Article 4 of the Wet Goed Verhuurderschap, varies by municipality. Reports in the Gemeente Rotterdam can be made through the following link.
